The inventors’ first step: patent protect their invention. Russ Weinzimmer himself completed a successful Patent Application that eventually issued as a U.S. Design Patent. After that, Invention Market Analyst Joe Carlen created the Commercialization Plan and drafted a Professional Outreach Letter the inventors used to approach major retail outlets.
Now, Pad Soleil™ is being sold in Bed Bath & Beyond® stores across the country, in the Better Homes & Garden catalog, and on the Wayfair website.

Remember the days of going to your local video store and picking out movies to rent that weekend? Remember getting that red Netflix envelope in the mail?
It might surprise you to know that video rental companies did not have to pay for the rights to rent those movies. They simply bought the same videotapes and DVDs that the general public could buy, and then used the “First Sale Doctrine” from Copyright Law to rent them out. Anyone could buy a bunch of movies and open a video rental store, and those mom & pop shops flourished before big chains put them out of business.

The benefits of a patent are that it provides credibility, legitimacy, and exclusivity. It helps to market to consumers, investors, and lenders who know that a patent confers a business advantage. The patent holder is more likely to obtain investment funds, loans, or grants, because there’s something in which to invest, an asset created by the patent.

A patent is primarily a business tool – so hiring a patent lawyer with business experience can be a valuable asset. Most patents are not litigated, so the key value of a patent is its business value. It takes a lot of technical and legal skill to draft a good patent, but business insight can substantially improve the value and effectiveness of a patent.
