Do I need a Patent Attorney Near Me?
And my answer is: “No, you need the right patent attorney for you.”
Patent Attorneys are Not Like Other Lawyers
Many people assume that patent attorneys are just like other lawyers, such as criminal lawyers, real estate lawyers, and divorce lawyers. You need to find such lawyers locally in your own state. But patent attorneys are very different. You don’t need a local patent attorney.
Patent Attorneys are Licensed to Practice Nationally
Patent Law is based on Federal Law, not State Law. Every patent attorney is licensed to practice nationally by passing the Patent Bar Exam given by the US Patent & Trademark Office. Finding a “patent attorney near me” is not necessary.
Patent Attorneys are Specialists
If you needed brain surgery, you wouldn’t go to your local family doctor. You would go to a neurosurgeon that specializes in the specific type of brain surgery that you need, even if they weren’t local to you.
Just like a brain surgeon, a patent attorney is a specialist. The vast majority of lawyers are NOT licensed to practice Patent Law.
A patent application is the most complex legal document there is. To prepare a patent application requires not just legal expertise, but also technical expertise. In fact, just to sit for the Patent Bar Exam, an attorney must have a degree in science or engineering.
This means that patent attorneys are rare. In fact, less than 2% of all attorneys are patent attorneys. And outside of a big city, finding a “patent attorney near me” can be almost impossible.
You Need the Right Specialist: One That Focuses on Inventors and Entrepreneurs
Just like you wouldn’t risk your life choosing a local brain surgeon just because they’re local, you shouldn’t risk your business choosing a local patent attorney just because they are local.
- Most patent attorneys specialize in serving large corporations, either working for a large law firm or serving as a company’s own in-house counsel.
- Fewer patent attorneys specialize in helping start-ups, entrepreneurs, small businesses, and individual inventors.
Patent attorneys that mostly work with large corporations are not enthusiastic about working with individual inventors and entrepreneurs, and usually don’t have the needed business experience.
Most large patent law firms focus on large companies with streams of patent work. Smaller businesses and individuals don’t represent a stream of patent work, so they often don’t get the attention they require.
Individuals, small companies, and start-ups need a patent law firm that is experienced with and passionate about working with individual inventors and entrepreneurs. As rare as patent attorneys are, even fewer patent attorneys focus on smaller clients, and therefore they are almost never found locally.
Big Law Firms Cater to Big Clients — You Get Lost in the Shuffle
We Serve Smaller Clients That Larger Firms Neglect
Patent Law Firms Catering to Entrepreneurs Work with Clients Nationwide
Patent law firms with an entrepreneurial perspective must reach out nationally, since there are not enough individuals, entrepreneurs, and start-ups locally to support such a highly specialized patent law practice.
Russ Weinzimmer & Associates, PC offers business support services that typical local patent law firms don’t offer, because large corporations don’t need such services. However, individuals, entrepreneurs, and start-ups greatly benefit from them.
Having a Local Office Increases Overhead, Increasing the Cost to You
Brick-and-mortar office space increases overhead, which is passed on to clients. Big law firms, in particular, are known for choosing high-end, expensive downtown office space to impress clients.
Most patent law firms that focus on local companies can only get enough business by serving large metro areas like Los Angeles, Chicago, Houston, and New York City. Those metro areas are much more expensive to operate in due to higher office rents, higher cost of living, and resulting higher attorney salaries.
Clients of local law firms in large metro areas pay more for the same service to cover the higher overhead.
Would you rather spend your money on fancy office space for your lawyer or spend it on a better lawyer?
It’s Faster, Easier, and Less Expensive to Work with a Patent Attorney Electronically than to Meet at Their Office
A phone conversation with a patent attorney is all that’s needed to start the patent process. Based on that conversation, the patent attorney needs to receive via text or email: drawings, photos, diagrams, and/or written descriptions of the invention to quickly and efficiently move forward with the patent process. Even if you meet locally with a patent attorney, all of this documentation is needed in electronic form.
It is faster, easier, and less expensive for a client to communicate via phone, email, and texting than to drive a distance, risk accidents and traffic delays, and pay for tolls, gas, and parking.
At Russ Weinzimmer & Associates PC, there is no gatekeeper between you and your patent attorney. And usually, no appointment is needed. Just call or text anytime, and your attorney will respond promptly, or if working with another client, will get back to you as soon as possible.
When Practicing Patent Law, No Location is Better than Any Other
The US Patent & Trademark Office is located in the Washington DC area. All patent attorneys, regardless of their location, work remotely with the Patent Office electronically.
Even patent attorneys located in the Washington DC area work with the US Patent Office electronically. These days, it’s very rare for a patent attorney to physically meet with an Examiner in the Patent Office. All communications with the Patent Office are via email and direct electronic filing, as well as via phone.
So it doesn’t matter where your patent attorney is located, either in relation to you or to the Patent Office. All patent work is conducted electronically.

WHAT OUR CLIENTS ARE SAYING
My company is in California. I began the patent work two different times with California Patent Attorneys. Both were woefully inadequate.
My company is in California. I began the patent work two different times with California Patent Attorneys. Both were woefully inadequate in answering my calls or following up with our discussions and moving ahead with the patent work.
When I decided to find another Patent Attorney, my wife decided she should go to the internet and find someone who was highly recommended by people who had actually had experience with the attorney. This proved invaluable to us! She found Russ Weinzimmer (Strategic Patent Law). I was a little uneasy about working with someone who could not come to my office, see my invention, and talk about the strategy for obtaining a patent, but my wife felt we should go ahead and call Russ.
Even though we have never met Russ “eyeball to eyeball” he treated us with respect and encouragement from the very first telephone conversation. Russ answered my calls and emails in a timely manner. He worked closely with me in educating me as to the things I needed to do in order to give him the information he needed. We accomplished all the patent work by email and telephone and I felt I was getting his best efforts at all times. … Read More
I’ve been treated with more respect and professionalism from Russ being in another state versus other attorneys here in my own city.
I’m thankful for how quickly Russ and his team have responded to me as I start up my new company. As a small business, Russ has been there to answer all my questions and make himself available over the phone, as well as through email even outside normal business hours.
I’ve worked with attorneys locally in my city who did not give me this type of attention and peace of mind that I need with my copyright and trademark. I’ve been treated with more respect and professionalism from Russ being in another state versus other attorneys here in my own city. The customer service from Russ and his team have proven to be available with responses within the working day, if not sooner. Thank you for this!
Everything I read said that you need a good patent attorney to protect your idea. I live in South Carolina, so patent attorneys close to me are not easy to find.
I did a lot of homework, and most everything I read said that you need a good patent attorney to protect your idea. I live in South Carolina, so patent attorneys close to me are not easy to find. I took to the internet and came across Russ Weinzimmer. His website stated that the patent attorney need not be local, so I gave him a call. Russ was very patient with me, and we spoke on several occasions before I hired him to work on my patent. This allowed me to be comfortable with him, and to figure out what I wanted.
He explained the entire process to me, and the time that it generally would take to get a patent. Once he got started, there was constant contact, and even if he was with another client he was quick to return my calls.

I had reached out to multiple local attorneys, but after I had spoken with Russ, I knew there was no reason to look any further.
Russ was absolutely wonderful. He was very thorough, responsive, and wise. I had reached out to multiple local attorneys, but after I had spoken with him, I knew there was no reason to look any further. The experience he has regarding intellectual property and copyright law is astounding. Seriously, don’t waste your time looking at anyone else. He works hard (and fast!) and will, without a doubt, give you the results you are looking for.
I was attempting to patent an idea “on my own.” I tried calling local attorneys, but I was just as confused after speaking with them. Then I called Russ, and I learned more from him in five minutes than I had learned in five hours of my own research. He was very helpful, and from the beginning it was like talking to someone I had known forever. I would definitely recommend Russ before anyone else.
