Learning how to write a patent application takes years of working as an apprentice with experienced patent lawyers and requires legal and technical knowledge, plus the ability to explain all of that in a clear, concise manner that can withstand attack from some of the smartest patent attorneys in the country if the patent becomes litigated.
I began with an idea and a set of sketches. I had no idea what I was doing. I needed help. I found Russ Weinzimmer on the internet and gave him a call. He was in New Hampshire, I was in California. I had bad experiences in the past working remotely with people so I was hesitant to work with him. Once I spoke to him on the phone, I knew he was someone whom I could count on.
Russ really took the time to explain to me the whole patent process and where I needed to be. He did it in such a way that I could plainly understand the process and the steps involved. He took the time to really understand my product and the reasons for it’s importance, both to me and to the end consumer. I felt that it was very rare for a patent attorney to invest so much time into a client before even discussing rates or cost.
I ended up filing 3 initial patents with Russ. As we spoke we determined that we should do multiple patents to better protect my product. This made perfect sense to me as other variants could compete with my product. If we patented them all, I would be better protected. Once the patents were filed I went on to production of my product. Later on that year I filed a fourth patent documenting the changes made during the production stages of my product. This fourth patent was filed very quickly for me as my product was scheduled to be released to market. He and his associate Bob worked day and night to get the patent filed for me in time.
I will say one thing, I was not the easiest client for Russ. This was the start of a new business for me, I had everything on the line. Because of this my nerves often got the best of me, and I would call Russ, concerned about one thing or another. Russ always had time for me. We would communicate at all hours of the day. One day he was on a walk and took the time to talk to me for a good 45 minutes. He really wants to help, and he makes sure his clients are all protected and at ease with the process.

As I said, filing for a patent is a unique experience, to say the least, with no guarantees of success. To paraphrase an analogy we had discussed; it’s like climbing up a tall mountain. There will be times in the process when you, as the inventor, may feel as if you are on the edge of a chasm, about to plunge to your doom. I know this feeling personally, as I reached that point myself somewhere along my journey. It was truly scary for me. To tell the truth, I got pretty freaked out. Yet Russ, and his team, were totally there for me! They calmly talked me through it, discussed strategies, got me off that precipice, got me back on the trail, and onwards and upwards we went.
You should be aware that filing for a patent will require a lot of work and effort by you, the inventor. You can’t just vaguely describe some “amazing gizmo” in broad strokes and expect a patent attorney to magically take it the rest of the way. It is a team effort. However, if you know what it is that you are innovating, and can accurately convey this description to Russ and his team, it is remarkable to see how they transform your descriptions into the final patent application and claims. The wordsmithing involved was truly a work of art. If you put in your best effort, they certainly will hold up their end of the bargain as well.
What else can I say? Russ it an extremely knowledgeable attorney. He’s easy to talk to. I have an extremely high level of confidence in him, and recommend him most highly.

My first invention was for the automobile industry. I used a television patent submission company, and they gave me a design patent that was useless. That patent is now nice wall art and nothing more, because it gave me no protection.
My second invention was a protective flip lid for the stainless steel tumbler market. I did a lot of homework, and most everything I read said that you need a good patent attorney to protect your idea. I live in South Carolina, so patent attorneys close to me are not easy to find. I took to the internet and came across Russ Weinzimmer. His website stated that the patent attorney need not be local, so I gave him a call. Russ was very patient with me, and we spoke on several occasions before I hired him to work on my patent. This allowed me to be comfortable with him, and to figure out what I wanted.
He explained the entire process to me, and the time that it generally would take to get a patent. Once he got started, there was constant contact, and even if he was with another client he was quick to return my calls. He did give me a lot of home work in looking through prior art found in the patent search to ensure that there was nothing like my invention on the market or previously patented. I appreciated being involved, because that patent process is a long one.
Once all claims were done, Russ gave me a call and said that he was sending me the draft of my Patent Application. I read it over and was satisfied, and told him that it was ready to file. A day or so later he called me back and said that he was not satisfied, and wanted to work on it some more. After a few more days, he sent me the now final draft, and I must say that I was satisfied with the first draft, but the final draft was outstanding. As I said, filing for a patent is a unique experience, to say the least, with no guarantees of success. To paraphrase an analogy we had discussed; it’s like climbing up a tall mountain. There will be times in the process when you, as the inventor, may feel as if you are on the edge of a chasm, about to plunge to your doom. I know this feeling personally, as I reached that point myself somewhere along my journey. It was truly scary for me. To tell the truth, I got pretty freaked out. Yet Russ, and his team, were totally there for me! They calmly talked me through it, discussed strategies, got me off that precipice, got me back on the trail, and onwards and upwards we went.
You should be aware that filing for a patent will require a lot of work and effort by you, the inventor. You can’t just vaguely describe some “amazing gizmo” in broad strokes and expect a patent attorney to magically take it the rest of the way. It is a team effort. However, if you know what it is that you are innovating, and can accurately convey this description to Russ and his team, it is remarkable to see how they transform your descriptions into the final patent application and claims. The wordsmithing involved was truly a work of art. If you put in your best effort, they certainly will hold up their end of the bargain as well.
